A Clay County judge has prohibited a Smithville man charged with felony child molestation from contacting two people or entering a Weston property.
Judge Shane T. Alexander modified Joseph P. Napolitano’s bond conditions during a Sept. 3 hearing in Clay County Circuit Court. Under the order, Napolitano may not contact the two people named in the filing or enter a residence in the 600 block of Platte Street.
The Chronicle is withholding the individuals’ names because the available public court records do not establish their ages or roles in the case.
The change was made following an oral motion by the defense and with the agreement of prosecutors and the defendant. All other previously ordered bond conditions remain in effect. Napolitano remains free on bond.
The hearing followed an Aug. 21 motion asking the court to revoke Napolitano’s bond or impose a higher bond or additional conditions. The public docket does not explain what prompted that request or why the two people and Weston property were included in the subsequent order.
Napolitano is charged with one count of second-degree child molestation involving an aggravated sexual offense. The Class B felony charge alleges the victim is younger than 17 but older than four years older. The alleged offense occurred April 7, according to court records.
Napolitano has pleaded not guilty. The charge is an allegation, and he is presumed innocent unless proven guilty.
His jury trial remains scheduled for March 15, 2027.
